Terms and Conditions

 

Your use of the myTV SUPER WhatsApp Customer Service Platform (“Service”) to communicate with MyTV Super Limited (“myTV SUPER”, “we”,“us” or “our”) constitutes your acceptance of these terms and conditions (“Terms”) and the privacy notice (“Privacy Notice”) herein. WhatsApp refers to the instant messaging application offered by WhatsApp Inc. which is owned by Facebook, Inc. Only the account with green badge next to the WhatsApp contact’s name is our official account verified by WhatsApp.

You agree to use the Service in accordance with these Terms and the Terms of Services of myTV SUPER (the “Terms of Service”) (https://www.mytvsuper.com/en/tos).

You agree not to send us or our third-party service providers any harassing, offensive, abusive, disruptive, threatening, menacing, seditious, indecent, obscene defamatory, fraudulent or other unlawful information through the Service.
3.          You agree to avoid sharing confidential information (including personal information) with us through the Service unless we have confirmed that it is necessary to do so.
4.          You agree not to use the Service in any way that breaches any applicable laws, promotes illegal activities or contravenes or infringes the rights of any person or is otherwise unlawful.

You agree not to impersonate or otherwise misrepresent an affiliation with another person or entity in a manner that does or is intended to mislead, confuse or deceive others (including us) when using the Service.
6.          If you receive a message from us by mistake, you shall not copy, forward, disclose or use any part thereof. You agree to delete any such message and all copies thereof, and to notify us immediately by replying to us.
7.          We may at our sole discretion and at any time change the scope and features of the Service or suspend or terminate the Service without liability to you. 
8.          You agree that you are solely responsible for taking all reasonable precautions to prevent any unauthorized or fraudulent access to your mobile devices, WhatsApp account or any messages sent to you under the Service.

We may amend these Terms and the Terms of Service from time to time at our sole discretion without liability to you. We will use reasonable endeavours to give you notice of any such amendments but you agree to check https://www.mytvsuper.com/en/tos_im regularly for any updates. By continuing to use the Service following our publication of the amended Terms and the amended Terms of Services, you accept and agree to be bound by the amended Terms and the amended Terms of Services.
10.                  We do not warrant the timeliness, accuracy, relevance, adequacy, quality or fitness for purpose of the Service or any information provided through the Service and shall not be liable to you for any losses, damage or expense of any kind which you may incur or suffer arising therefrom or in connection therewith.
11.                  Your use of WhatsApp will be governed by separate agreements you have with them and it is your responsibility to comply with them. It is also your responsibility to check regularly for any updates to their terms and conditions, polices, etc. and it is for you to decide if you continue to find the same acceptable and continue using WhatsApp.
12.        We cannot guarantee that WhatsApp is secure, error or virus-free, nor can we warrant that there will be no interruption, delay or mutilation in using WhatsApp or the Service.
13.        We shall not be liable to you for any losses, damage or expense of any kind which you may incur or suffer arising from or in connection with:-
 
(a) your use or inability to use the Service or WhatsApp;
(b) any failure, interruption or delay in providing the Service for any reason (including as a result of processing a high volume of enquiries at any given time and any technical error or failure);
(c) any delay, loss, diversion, interception, alteration or corruption of any message sent to you or received from us; or
(d)

any loss or damage to your data, software, mobile device or other equipment arising from or in connection with your use of the Service, to the extent that it is attributable to any cause or circumstance that is beyond our reasonable control.

Our maximum aggregate liability to you or any person for any and all losses, costs, or damage arising out of or in connection with these Terms will be limited to HK$500.

Nothing in these Terms is intended to or shall confer upon any person other than you and us any right, benefit or remedy of any nature whatsoever under or by reason of these Terms. The provisions of the Contracts (Rights of Third Parties) Ordinance (Cap. 623) of the laws of Hong Kong Special Administrative Region (“Hong Kong”) are expressly excluded.

These Terms are governed by and will be construed in accordance with the laws of the Hong Kong. The parties agree to submit to the exclusive jurisdiction of the Hong Kong courts.

The Chinese version of these Terms is for reference only. If there is any inconsistency or conflict between the English and the Chinese versions, the English version shall prevail.

 

Privacy Notice

We will collect, store and use your personal information and may record and monitor all communications with you through the Service in accordance with these Terms, this Privacy Notice and our Personal Information Collection Statement (“PICS”) (https://www.mytvsuper.com/en/pics). We may amend this Privacy Notice and our PICS from time to time and though we will use reasonable endeavours to give you notice of any such amendments, you agree to visit https://www.mytvsuper.com/en/tos_im regularly for any updates. By continuing to use the Service after any amendment to this Privacy Notice and our PICS, you accept and agree to be bound by our Privacy Notice and PICS as amended.

We may also share your personal information and the contents of the messages sent to us through the Service with third parties for the purpose of enabling, maintain and supporting the Service as well as other purposes set out in our PICS.

WhatsApp may collect will collect, store, use and share your information (including personal information) in accordance with their privacy policies. We will not be responsible for any leaks, usage or handling of information by any third party, including WhatsApp Inc.
